If an accident or violation is removed from my record, do I still need SR22?

Direct Answer

It depends on how it was removed. If the violation that triggered the SR22 was expunged, dismissed, or overturned, the SR22 requirement may be removed — but only if the state's DMV updates your record to reflect that. Contact the DMV to confirm. If the violation was simply 'aged off' your driving record for insurance purposes, the SR22 requirement may still be active.

Expunged or Dismissed vs. Aged Off

  • Expunged/Dismissed/Overturned — If the conviction itself was legally vacated, you may be able to get the SR22 requirement removed. Your attorney should file the appropriate paperwork with the DMV, and the DMV must update your record.
  • Aged off — Violations eventually stop appearing on insurance reports (typically after 3-5 years). This does NOT remove an active SR22 requirement from the DMV's system. The DMV and the insurance reporting system track different things.

Always Verify with the DMV

Never assume the SR22 requirement is gone. Contact your state's DMV directly and ask whether the SR22 filing requirement is still active on your driving record. If it is, you must continue carrying the coverage regardless of what your insurance company's records show.

If you're told the requirement has been satisfied or removed, get written confirmation before dropping coverage.
