Virginia DUI Diversion & FR44 Guide (2026)

Virginia DUI Diversion Programs in 2026

Virginia has some of the strictest DUI laws in the country. The Commonwealth does NOT offer traditional DUI diversion or deferred adjudication for first-time offenders. However, Virginia does offer several alternative sentencing programs and a unique VASAP (Virginia Alcohol Safety Action Program) framework that functions similarly to diversion in practice.

Why Virginia Has No DUI Diversion

Virginia law (§ 18.2-271.1) mandates minimum penalties for DUI convictions that judges cannot suspend or reduce. Unlike states like Texas or California, Virginia prosecutors cannot offer diversion agreements that dismiss DUI charges. A Virginia DUI conviction stays on your criminal record permanently.

Virginia ASAP (Alcohol Safety Action Program)

Every person convicted of DUI in Virginia must complete VASAP. This is not optional — it’s a court-ordered requirement under § 18.2-271.1:

  • Assessment: Alcohol/drug evaluation to determine treatment needs
  • Education: 20-week ASAP class (first offense) or 26-week program (second offense)
  • Treatment: If assessed as substance-abusing, mandated treatment program
  • Monitoring: Random drug/alcohol testing during probation
  • Ignition Interlock: Required for all DUI convictions (minimum 6 months first offense)
  • Cost: $300-$1,500+ depending on treatment level required

Restricted License in Virginia

Virginia offers a Restricted Driver’s License during your suspension period. This is critical because:

  • First offense: License suspended for 1 year (no restricted license for first 30 days)
  • You must install an Ignition Interlock Device (IID) for at least 6 months
  • You must complete ASAP enrollment within 15 days of conviction
  • FR44 filing required (Virginia is an FR44 state, not SR22)
  • FR44 coverage limits: $50,000/$100,000/$40,000 (50/100/40 — double the standard minimums)

Virginia DUI Penalties (First Offense)

Fine $250 minimum (mandatory)
License Suspension 1 year (restricted license available with IID)
FR44 Required Yes — 3 years, 50/100/40 limits
Ignition Interlock Minimum 6 months on restricted license
ASAP Program Mandatory — 20-week education + treatment
Community Service Optional in lieu of jail (judge discretion)

Reckless Driving Reduction (Wet Reckless)

In some Virginia jurisdictions, prosecutors may agree to reduce a DUI charge to reckless driving (§ 46.2-852) — sometimes called a “wet reckless.” This is not diversion, but it’s the closest equivalent. Benefits:

  • No mandatory minimum jail time
  • No FR44 requirement (unless DUI-specific conditions apply)
  • Shorter license suspension
  • No ASAP mandate

However, wet reckless reductions are rare in Virginia and typically only offered when BAC is borderline (0.07-0.09) or evidence issues exist.

Virginia FR44 vs. SR22

Virginia is one of only two states (with Florida) that uses FR44 instead of SR22. Key differences:

  • Higher coverage limits: 50/100/40 vs standard 25/50/20
  • 3-year filing requirement from reinstatement
  • Stricter enforcement: Any lapse resets the 3-year clock
  • Cost: FR44 policies cost 30-50% more than standard SR22
